DALeast ๐จ๐ณ Wuhan, China โข Street Art โข Based in Cape Town, by bjornca on Sept 6, 2014 0:45:38 GMT 1, In what court is that agreement enforceable even if you signed it? No one can tell you what you can do with an item you bought. However, they do have the right to blacklist you the next time you buy from them just in case you get caught. Don't agree. You are entering into a contract to be able to acquire the work - if you don't agree to the terms, you don't purchase it. However, given the dollar value, wouldn't be worth it to enforce in a court, but could see them having any pulled from auctions (including Ebay) as they have proof of a no-sale clause. There are definitely contracts from certain galleries that mandate that acquired works are not sold at auction for a certain period, they have a right of first refusal to repurchase or any secondary sale needs to be sold through the selling gallery, etc. so they can control their artist's market.
This came out the other day - cease and desist from Ferrari as they didn't like the wrap that was put on a car they sold... mashable.com/2014/08/30/ferrari-deadmau5-cease-and-desist/

Not saying I agree with what Ferrari did, but shows there are pretty strict conditions in sales agreement that would even lead to such letter. Definitely not helping customer retention with someone spending $400k+ on a car.
Edit: And Toronto is a great city. Originally from up that way.

It's a trademark violation and with his public exposure not surprising.

DALeast ๐จ๐ณ Wuhan, China โข Street Art โข Based in Cape Town, by met on Sept 6, 2014 7:07:52 GMT 1, Thanks again kultur will take all your adivce on board once i receive the canvas and i have had it framed will post on forum so you can all check it out. DAL's canvasses usually have some nice staining on the sides of the canvas... at least mine does and most of the ones I have seen do... so I would show them. Smartest thing would be to just find a good local respected framer to go over options when you have the piece. Right now you might not even know how thick the canvas stretcher bars are If money isn't too much of a concern, or if you're able and willing to splurge, you cannot do better than Tru Vue Optium Museum Acrylic:
www.tru-vue.com/products/optium-museum-acrylicโ
According to the website, it blocks out 99% of UV light. The blockage percentage doesn't get higher. And yet it still offers very high light transmission โ meaning that, appearance-wise, works will largely retain their natural clarity and contrast.
In addition, this acrylic is scratch-resistant, shatterproof and (best of all for your visual experience) anti-reflective.
[When viewing pieces in person or online, there's nothing I find more distracting than reflections in the glazing. It's one of my three major art-related pet peeves, the other two being (i) the abuse of the word "iconic" when describing art, and (ii) dishonest or clueless attempts to elasticise or relativise the extreme / absolute condition-description term "mint".]
Another benefit with the above are the anti-static properties. Static can be a problem since regular acrylic often becomes a dust magnet.
For additional background, when it finally reopened in April 2013 after a 10-year closure for renovations, the Rijksmuseum in Amsterdam announced that all of its works on paper (including photographs) had been reglazed with Optium Museum Acrylic.

DALeast ๐จ๐ณ Wuhan, China โข Street Art โข Based in Cape Town, by met on Sept 6, 2014 7:22:56 GMT 1, I've tried hard over the years to like Dal's work, but having looked through this work again and again over the last day or so, I'm still cold - if the only development is a few different objects and colour, it doesn't seem like much to me - oh well, that's art I guess Why feel the need to try to like work by a particular artist? That's the part I don't get.

my artist was bast ... until I went a saw a show of his featuring extensive work I did not get what everyone else got ... that is not to say that I like all of his work but now 'I like'

As far as I know, it is against the law in the United States to prohibit people from selling property that they have acquired. This includes art music and film. One may not reproduce, but one can sell their personal copy. Am I wrong?
if not, then it will take someone wealthy trying to resell a piece and then having to sue the gallery in order to have a precedent set.

Nor does it mean a court of law would enforce any of the provisions.
No-resale or conditional resale agreements conflict with the very nature and characteristics of private property ownership.
Through capriciousness, I can offer to sell you a doughnut subject to the condition that it may be displayed in your cupboard or fridge, but under no circumstances should it be eaten before September 2017. You could accept and enter into a written contract with me to this effect.
If you then ate the doughnut immediately, I'd hold up my copy of the contract, shake my fist and yell, "You made a promise to me, bjornca! We had an agreement. God damn you. God damn you to hell, or even worse!" This would be an ethical and relationship matter, perhaps even a psychiatric matter, but not a legal one.

Theyre still sold from show at approx ยฃ500 / $800 and from what I gathered both shows sold fairly instantly so I cant imagine letting it go for half the cost or less as that would be the definition of insane lol

You should probably just hold on to it then; it's a small piece to take with you. Anyways, here's a link to show you what a similar sketch fetched on Ebay:
