Banksy+BNE for World Water Day, by Deleted on Mar 26, 2014 15:39:13 GMT 1, I asked him last night why he was still taking orders and exactly how many did he sell the other day. He wrote a long response of drivel. He did say that because he 's not got Paypal, he's not selling.... He's just making a list of more future orders.. LOL
No answer to the simple question of units sold.

Banksy+BNE for World Water Day, by thisisanton on Mar 26, 2014 15:55:56 GMT 1, Anyone else have a hold placed on their paypal refund? That is strange, the money from Diz Art was available immediately, in fact I don't remember EVER having a hold on a refund. Checked my PayPal I received all of the money. The status says complete.

Banksy+BNE for World Water Day, by randomname on Mar 26, 2014 16:01:09 GMT 1, Speaking of t-shirts Banksy didn't design, this is available for roughly $23.

It says "Don't give it to Russians." They're raising money for the Ukrainian army. I'll let you work out what "it" is.

Does it say "Hold" somewhere or have the funds not shown up back in your account/credit card. Mine shows up as "complete" on Paypal, but I don't think the funds have been transfered to my credit card. I'll have to call my cc today.

I guess I was mistaken...I double checked everything, from the Invader/Faile order it says "completed" half of the money went back to my PayPal balance and the other half to my credit card which hasn't showed up on my statement. For the "Banksy" order under type it says "Temporary Hold" and under status it says "Placed". This is a mess...

Banksy+BNE for World Water Day, by Deleted on Mar 26, 2014 18:24:48 GMT 1, That was/is not allowed.. Someone posted the banksy trademark 'thing'.
And i think it a bit lame since everybody suggested it already. The 'joke' is old already. And a bit easy and pricey to stick someone elses idea on a shirt and sell it for 80usd a pop. In that case the invader collab was MUCH better.

Banksy+BNE for World Water Day, by behaviorist on Mar 26, 2014 18:30:58 GMT 1, indeed, maybe using banksy's quote isn't the route BNE's taking, but i'm not sure i'd chalk that up to the illegality of it.

Banksy+BNE for World Water Day, by jacktwo on Mar 26, 2014 18:41:25 GMT 1, this comment for the first time has made me think about asking for a refund...
"change of plans. It looks like the tee will be designed by the people who bought it. Many of you have been emailing and it's pretty clear what a lot of you want....details soon"
I agree, i would be happiest if he refunded the money without having to ask for it.. and then try to set another idea..and the people who want can donate..or wait and buy his next offering. I think it would be his best bet of not losing all respect

Is also not allowed for WCP to be selling Banksy replicas but Banksy has not stepped in and stopped them. WCP had been selling replicas for a long time now.

This was about T-shirts....
Interesting thing. I was looking up the banksy trademark and came across this. tsdr.uspto.gov/#caseNumber=85198175&caseType=SERIAL_NO&searchType=statusSearch"Banksy" is currently an active trademark. If you click goods and services to expand it you'll see that it covers clothing, specifically tshirts. Even if banksy posted that sentence of "Banksy has not made any t-shirts for a water charity," if BNE doesn't have permission then he can't use that sentence. He can't even write "Bansky" because it is confusingly similar. The defenses to trademark infringement are fair use and parody. I really don't believe that this would fall into either category. So with the "theory" that Banksy has given him a gift by putting that statement up on his website, if BNE doesn't have permission, he can't really use it on the shirt. It also doesn't help that it isn't fully for charity and there is some profit there that is paying the person in india or whatever he said. Just some insight into more of the legal matters that I'm sure some people aren't aware of. Another discussion that shouldn't take place here (although this whole thread is pretty much unnecessary) is how banksy was able to trademark what would be considered a pseudonym without using his name. Interesting read here: everythingtrademarks.com/2013/12/07/banksy/

You own the copyright to the images you create and someone else making a profit off that is not fair use or parody.
I get your point tho

Banksy+BNE for World Water Day, by bullysonzx10r on Mar 26, 2014 19:05:12 GMT 1, So... This means we're going to get a T-shirt with a banksy quote on it...? That doesn't really make it special, or worth $80 as opposed to the $40 for the shirts designed by Falies Invader and Shep... What a bunch of shit.

Banksy+BNE for World Water Day, by Deleted on Mar 26, 2014 19:09:23 GMT 1, Before reading any further : Please keep in mind i am a big fan of BNE, and i do support him with his fundraising. But his latest move makes me wonder.....
Rules have changed a couple of times since the start. This is the first time i am contemplating about asking for a refund. Charity and donating aside. This is the first time i feel tricked into spending my hard earned cash into something i don't agree with. But i can't be sure because nobody tells me what i am about to buy/ what i have bought?? I am told that 60usd of the 80 went to charity... but what happend with the other 20usd? Did i just pay 20usd to a guy who keeps ignoring my questions about what happens with the 20usd? And he also does not answer the questions about the total amount of tees that has been sold. And how can i be sure that 60usd of the 80 goes to charity?
I have spend 100usd on a tshirt of which i was under the intention it was a collab with Banksy. BNE did not only suggested it but also wanted us to believe it was a collab with Banksy. That was the whole idea of it all. Then it turned into a social experiment. People got upset a bit. So then he turned into a collab with another artist. People were getting refunds but the rest settled down a bit. But now he suddenly changed the rules again and he is letting the people who bought the shirts do the design?? This idea/experiment keeps spiraling down.... How is this still worth 20usd?
Why don't we donate to charity and make our own tshirts with our comments / Banksy's comment on them? Would be a lot cheaper than the 20usd BNE uses for expenses of his organization. And saves another 20 for shipping.

Banksy+BNE for World Water Day, by zefarrett on Mar 26, 2014 19:15:15 GMT 1, He has previously said that with the 20, that included the price of the shirt and paying some dude in india or something who is keeping the whole thing running.
This is what I've been saying all along and some people have gotten super defensive for BNE. I really just want to know WHAT I purchased. At this point, I don't care about the limited thing, just tell me what I bought. It has changed way too many times. He needs to pick one thing, let us know what it is and then go from there.

Banksy+BNE for World Water Day, by Dr Plip on Mar 26, 2014 19:23:18 GMT 1, this comment for the first time has made me think about asking for a refund... "change of plans. It looks like the tee will be designed by the people who bought it. Many of you have been emailing and it's pretty clear what a lot of you want....details soon" Oh no.

Banksy+BNE for World Water Day, by Deleted on Mar 26, 2014 19:27:38 GMT 1, ....At this point, I don't care about the limited thing, just tell me what I bought. It has changed way too many times. In case he sold more than 500 he should donate that difference to charity too.
He needs to be clear on the numbers...

There has to be a way to figure out the quantity. Are there consecutive order numbers?

Banksy+BNE for World Water Day, by Coach on Mar 26, 2014 19:38:29 GMT 1, So... This means we're going to get a T-shirt with a banksy quote on it...? That doesn't really make it special, or worth $80 as opposed to the $40 for the shirts designed by Falies Invader and Shep... What a bunch of s**t.
But he's said have a refund if you want. Several times. And the payment is mostly a donation to charity.
I would have preferred a banksy t shirt. But in view of the two points above, I can't get angry about this and nor do I want a refund.
