The artwork starts from a vision, turning every lyric into a visual story for all of us to experience. The art work depicts musical icons throughout generational eras such as Audrey Hepburn, Blondie, David Bowie, Elton John, John Lennon, The Beatles, Marilyn Monroe, and Mick Jagger with the objective of these icons retaining their legendary iconic status throughout time. Rather tragically, no precedent was set.
Fairey's legal position had been very strong. He contended his conduct didn't constitute improper appropriation, and that it was justified regardless by the fair use doctrine.
I believe he would probably have won the case. However, it seems the personal, financial and general legal stakes were too high for him to risk a trial. Especially given he had stupidly (and completely unnecessarily) undermined his credibility through perjury, combined with the destruction and falsification of evidence.
The dispute was settled out of court. But the key point is that neither side surrendered its view of the law.
