I would send them a politely worded email that you find the delay in payment extremely worrisome and unwarranted and you will go public with the delay and that you are in contact with a large group of consignors. Hell, Artnet might even publish your story. I certainly will wait and list my prints with Artnet instead of Paddle8 if you are not paid promptly.

Yes, Buyers paid asap as that's the only time they respond is if it has to do with money! I'm thinking of going back to Artnet even though it is pay to play. If I had known that the buyers were getting them on consignment I would of never signed the contract.

Their financial issues are now well known, they haven't paid because clearly the funds have been swallowed up by the business and now they are hoping a white knight saves them. It's not looking good alas.
What I find deeply annoying is that they are still advertising sales and conning people into consigning even though there are clearly dozens of people owed money by them. More the fool me for consigning but frankly I did it as a favour to an old friend, and thought their clients might have been more suited to the items I wanted to sell. I'm only lucky more of the things I had in those sales didn't sell or I would be well and truly F'd.

I wouldn't want to be owed money by them right now.
Interesting aside. It is my understanding that in New York, whose laws govern P8 sales/consignments, if you consign artwork to a gallery and it goes out of business, you are an unsecured creditor and at the back of the line as far as payment is concerned. Your consigned work can be seized to satisfy debts to more senior creditors(unless you are the artist yourself). Yes, your property can be legally taken and you are out of luck. This is unless you file certain paperwork with the state(or county, forget which) ahead of the consignment(a UCC-1 form creating a lien associated with the work) which jumps you up in the order of creditors. So, if they go bankrupt, could we see Paddle8's creditors come knocking on the doors of those with active consignment agreements looking to seize artwork? According to the contracts, the consignment extends to any unsold artwork for 60 days after an auction. I doubt, but the law and art is a very interesting topic.
