Case studio NO-RESALE AGREEMENT, by Arty Farty 15 on Sept 22, 2020 11:17:16 GMT 1, Did anyone apply? I nearly did but couldn't think of where I'd display it That's the problem with this piece. You could only really display it close to a wall socket. And even then, you've got ugly wires trailing down the wall. Having said that, I'd still rather like one. Todays the day when people are notified.
Fair point about the ugly wires but considering people on here frame rugs, postcards, stickers and door mats then no doubt they won’t care about the wire

I have a wire phobia
Happy to frame rugs, postcards etc, but the thought of a wire trailing down a wall...no no no. I would if necessary chase that wire into the wall.
Whats wrong with framed rugs or mats anyway? They are the new canvases, some people need to move with the times

Case studio NO-RESALE AGREEMENT, by orchid on Sept 22, 2020 11:46:16 GMT 1, I don't think a single, slim wire is that big an issue, especially when displayed so as to conceal it as much as possible, it is a light-based installation after all, and his most ambitious edition to date.
Or just hang as a donut sculpture on its own.

Case studio NO-RESALE AGREEMENT, by matgab on Sept 22, 2020 12:29:19 GMT 1, Maybe there is a solution, to plug it into a battery. Like that the wires can be hide behind the donut. Or you put a new plug on the wall at the good height. Or yes like orchid said, we can cut the wires !.

I display pieces that require to be plugged in. It’s easy to hide the wire by drilling a small hole behind the piece, fishing it through the wall to the bottom plug. Similar to how a lot of televisions are wall mounted while hiding all wiring. Good luck with the raffle!

Case studio NO-RESALE AGREEMENT, by brycepen on Sept 30, 2020 5:42:45 GMT 1, You don’t sell it for 2 years. Simples They don’t want them being flipped so you agree to the conditions to give them confidence in you. Not worth the paper it’s written on legally but reputation is everything in this game and breaking such an agreement will get you blackballed. Yeah I got that thank you. But how does that legally works, how could they find out. What could they do against you ? It's actually the first time I see this, could this be the new thing against flippers ? I don't think it is "such" an agreement. I don't think that would damaged your "reputation" so badly unless you are a big well known art dealer. And you can just no put your own details to order the piece so I don't find your argument relevant
This can absolutely be done legally in a binding contract through
1) actually putting a financial penalty on resale through estimated liquidated damages for breach of contract
2) have the parties agree to define bad faith, material breach within the sales agreement as any buyer who purchases the art to resell for profit.
3) have the parties agree to define “buyer” as a retail consumer and not a wholesaler, dealer, or entity in the business of buying and selling art.
4) have the parties agree that any person or entity who enters into such an agreement enters it in good faith and without any concurrent or subsequent agreements to transfer the piece to a third party for profit.
5) allow unhappy buyers to rescind on the purchase within 90 days, provided the item is returned in new condition.
6) force arbitration on any contract disputes re: resale with arbitration fees paid for by the buyer
7) allow the seller to seek damages in the form of lost profits and attorney’s fees as a result of a material breach.
I can think of endless ways to do this legally......
