No, I don’t think that’s what happened, or even possible. You can’t sneak fakes into a collection, but you can make separate NFTs with similar images and a very similar name, and try to trick people… that’s been happening before the official release.
What happened here was simply that no raffle entries were picked. All sold to whitelist or VIPs (or this is what people think happened)

I don't agree with some of the suggestions in the article, but opinions aside I think it's uncontroversial to say that as value (and fraud) associated with these projects increase, so will SEC interest. They are already engaged in enforcement actions related to crypto and defi and we are watching the vast potential for abuse play out in real time.
I saw an estimate that this minting was generating investment somewhere in the $11M range - I don't know if that's an accurate number, but would certainly be enough to draw enforcement interest.
