A no resale agreement has been challenged in court multi times and in every single instance the gallery and or artist has lost as it has been deemed legally non binding.

Buying and selling on FairArt is completely anonymous, no personal information on transactions will ever be shared with galleries or artists. The privacy of our users is paramount and they must feel as though their information is secure.
Yes, artists will be aware of which works have sold, but so will all users on FairArt. In the interest of transparency, we make past sales data readily available for each artwork to help collectors make better informed decisions on buying and selling. To be clear, the only available information to artists, galleries and collectors is the date of a sale and its value.
This does not mean we encourage the prevalence of โflippingโ in the market, and we fully support the work primary galleries do to ensure the works they allocate end up in the hands of people who actually want them. Non-resale agreements are one of a number of obstacles galleries put in place to prevent flipping. Unfortunately, as Iโm sure you will know, they tend to hold minimal legal weight and are often ignored altogether.
The conclusion we came to was that reselling, whether the โgoodโ or the โbadโ kind, is always going to be a reality of the secondary art market. Currently, the only beneficiaries are marketplaces like Ebay / StockX and resellers; meanwhile the artist sees none of the short-term profit they create by making their works more accessible and affordable.
So if itโs going to happen, why should artists not at the very least receive a cut to minimise the harm done by short-term reselling and share in the value they create for others through their work? If resellers believe us to be whistleblowers they will simply go to another platform and artists will once again miss out.
We appreciate that discussions around the reselling of works can be highly charged, and there is rarely a consensus, but I hope the majority agree that the current state of affairs does little good for the wider art community and change needs to happen.

I typed in an artist and sorted by new to old and had to go through lots of listings that had nothing to offer for sale so I have up. I may have missed it but a way to filter out the unavailable works would be better, especially on mobile.

Arguably the 'used' market will be stronger than the new listing market in times like this.

the art market will suffer like all other markets this year but think this will do well.

I havenโt used yet but think this will do well as in reality auction houseโs take 50% of what they actually pay you and often donโt get good results and ask for low starting reserves. the art market will suffer like all other markets this year but think this will do well. |

On desktop:
1. Click on the 'Artworks' tab in the top navigation
2. Tick the 'Buy Now' filter under 'Availability'.
On mobile:
1. Open up the menu and click on 'Artworks'
2. Click on the Filter icon (this will open up all available filters)
3. Tick the 'Buy Now' filter under 'Availability' and click the 'Apply' button
Iโve attached some photos to better explain the above or you can simply click this link.
Please also note that the default sort ('Recommended') will always display artworks that are available first.

Regarding your question, early on we decided to prioritise the building of a website for a few reasons:
โข Make FairArt as accessible as possible. Building an app first would would have limited collectors to certain platforms (i.e., iOS, Android, or both) - websites are accessible to all.
โข A website gave us greater flexibility to launch fast and iterate quickly based on collector feedback. Maintaining both a website and platform-specific apps during this initial stage would have slowed us down considerably, both in terms of the launch and new features.
That being said, an app is certainly on the cards in the future. We hope for now however that the FairArt experience remains equally enjoyable across all devices.

Dealers who break non-resale clauses risk being blacklisted from the galleries / artists they originally made the agreement with. Although there is little to no chance of any legal repercussions, the relationship between artist / dealer / gallery may fall apart.
As mentioned earlier in this thread, all transactions on FairArt are completely anonymous in attempt to encourage sellers who sell in spite of non-resale agreements to use the platform and support artists through royalties.

Why would a dealer be given (or enter into) a non-resale agreement? Surely buying & selling is a dealer's business?
I understand that an artist may give to, or give special terms to, a friend or private individual which might include "don't ever sell this" but really its always going ot get sold at some point, whether in this generation or the next (I'm just clearing my mum & dad's house of the things that they held dear and know that I can't keep all of them .. some have to go. Sorry Mum, sorry Dad xxx)
