Banksy NOLA Print on POW, by grantb on Nov 27, 2008 17:49:48 GMT 1, you know, with all this bickering and bitterness, why should POW bother to offer anything to anyone - perhaps they should have made the print available to those who were prepared to make an effort for it, ie travel to Bethlehem or some far arsed place. Dont come back at me with, "well some of us don't have the time or money" crap, because those who do, have enough time to F5 for 3 days non stop or b**ch/complain for days on end about missing out. POW have acknowledged that they had some issues with duplicate prints - they have apologised, and let that be the end of it. Now someone please lock this thread!!!
i agree with that.
pow are very nice to offer people the next one. very fair imo.

Banksy NOLA Print on POW, by grantb on Nov 27, 2008 18:27:42 GMT 1, pow open day would seem unlikly. 2 prints in a matter of like a week. let alone this being his first release this year.
my guess a secret ghetto may be in line somewhere.

what's up, Bee? i haven't read through this entire thread and haven't paid much attention for about the last week, but wasn't your order the one that had its payment rejected 3 times? if so, i highly doubt POW is going to offer you anything. the offer is only for people who actually made it through the checkout completely and had an order confirmation. i'm on your side, dude, and i wish you the best of luck. but i seriously wouldn't get your hopes up unless you DO have a physical order confirm.....the orders are not complete until you've made it through ProtX successfully.
happy thanksgiving!

Banksy NOLA Print on POW, by veralynn on Nov 27, 2008 21:10:25 GMT 1, Anyone on here heard of the Unfair Contract Terms Act of 1977? It's statute and set up, to some extent, to protect people like me and you from organisations who might like to hide behind their 'terms and conditions', irrespective of whether 'we' have read them or not.
This has been an absolute debacle and it's not of POW's making - their plans to hold an 'open weekend' in my view seriously underestimate the volume/interest. If their intention is to generate publicity and 'revive' the scene that will work but at what cost?

Banksy NOLA Print on POW, by mammal2 on Nov 27, 2008 21:22:40 GMT 1, Have you or any of the other Thursday 'losers' had a offer from POW to buy the next print?? Dear Customer As you may already be aware a number of orders for Nola were duplicated by our database system. Unfortunately your order is one of those & because the database did not recognise your order we have had to refund it. Following some ebay refunds & Friday sales refunds we have still not been able to re-allocate you a print. I sincerely apologise for this. We would like to offer you the opportunity to buy the next Banksy print, the details of which will be known fairly soon. This offer will come by way of an email directing you to a payment page. If you do not want to be offered this chance please reply by return, otherwise you do not need to do anything. I would like to thank you for your understanding & continued support & apologize once again for the obvious disappointment at missing out on Nola. Kind Regards SIMON DURBAN MD
It doesn't get better than that! wow! no f5ing for you!

I've just taken a quick scan of the Unfair Contract Terms Act and you'll notice that the key word that is littered through the text is "reasonable"
Statute here:
www.statutelaw.gov.uk/legResults.aspx?LegType=All+Legislation&title=Unfair+Contract+Terms+Act+&Year=1977&searchEnacted=0&extentMatchOnly=0&confersPower=0&blanketAmendment=0&TYPE=QS&NavFrom=0&activeTextDocId=224526&PageNumber=1&SortAlpha=0
It is not unreasonable for POW to cancel duplicate orders. It is not unreasonable for POW to satisfy the orders that were canceled because of a faulty basket system. It is also not unreasonable to cancel the orders of those who purchased on Friday because there was no stock to fill them. It is also not unreasonable for POW to cancel orders of flippers. They only manner in which it would be unreasonable for them to cancel an order would be on the basis of race, gender, or religion as that would be discrimination.
But I suggest you go ahead and send the link to this statute to POW and see what they say.

Is it unreasonable to compensate the Thursday buyers and not those who bought on Friday morning? IMO Yes!

Banksy NOLA Print on POW, by funyoung on Nov 27, 2008 21:46:37 GMT 1, you know, with all this bickering and bitterness, why should POW bother to offer anything to anyone - perhaps they should have made the print available to those who were prepared to make an effort for it, ie travel to Bethlehem or some far arsed place.
Lock it why? Why don't you run along little alsababble.
Now. I want first dibs on the next release too. You see I missed out on both Thursday and Friday. Mainly because I was at work but the thought was there.

Banksy NOLA Print on POW, by veralynn on Nov 27, 2008 21:46:59 GMT 1, Cheers Chief, and I completely agree - how hard can this really be with a bit of application, its supposed to be a commercial organisation not a playground.
BTW Mr Pffffft, we also do age discrimination in this country now too and its a wonderful thing if you're old and you fancy a job advertised for someone between 18-25.
Also heard of a discrimination case where a firm unwisely advertised for a white van man and then when a black man applied for the job and didn't get it he sued them for racial discrimination and won, but I digress......
This thread should be locked however as I'm boring myself.

It's pretty clear you didnt read the statute. The key word is reasonable but these are the things protected against.
Negligence. s2(1), liability for negligence occasioning death or personal injury cannot be excluded.
Manufacturers' guarantee. s5(1), loss arising from (a) defective goods or (b) negligence of distributor; cannot be excluded where goods are "of a type ordinarily supplied for private use or consumption.
Sale of Goods
* s6(1), implied terms as to title (Sale of Goods Act 1979 s12) cannot be excluded. * s6(2), implied terms as to description, quality or sample (Sale of Goods Act 1979 ss13-15) cannot be excluded against a consumer.
There will be no death or personal injury if you dont get your print.
There are no defective goods here, you havent gotten your print.
And negligence of the distributor? What negligence? There is a term in US law called bona fide error. The prints Friday were released in error, not in some scheme to defraud you of your money, not in some scheme to cause you duress.
Would you all please stop this nonsense. Honestly.
Again, send this link over to POW and see what they say. Please, I beg you.
Are you a Judge fella? cos only then would you be in a position to decidee what is and isnt reasonable. Sale of Goods * s6(1), implied terms as to title (Sale of Goods Act 1979 s12) cannot be excluded. * s6(2), implied terms as to description, quality or sample (Sale of Goods Act 1979 ss13-15) cannot be excluded against a consumer. Banksy NOLA Print on POW, by pfffffffffft on Nov 27, 2008 21:51:01 GMT 1, Is it unreasonable to compensate the Thursday buyers and not those who bought on Friday morning? IMO Yes!
The compensation pow is offering is a courtesy, not a right.

I say there would be approximately 20 less pages of this nonsense - if you stopped inflaming the situation.
Why do you care so much for this subject?

Nice courtesy it is too. Does anyone know how many (or few) Friday buyers there were?

I would suggest those yammering on about lawyers are the ones inflaming the situation. Sorry, those making unreasonable demands, bringing lawyers into this are the ones being unreasonable here. Not me.
This is beyond ridiculous, I care about this subject because neither Banksy nor POW have to release Banksy prints yet they do, and at well under market value so those with lesser means can afford a Banksy.
POW was so generous in offering up some compensation yet people are still pitching fucking full on fits, it's bloody disgusting. People have the right to be disappointed but these attacks on POW are off the chart.
What's that saying, give an inch and they'll take a mile. Well there are some here looking to take a mile.
