is this a joke? you list an auction at ยฃ1 so it 'can find its true value', then decide not to sell it for the winning bid because "he could resell it for more", then relist way above last winning bid, then, despite having it on ebay, "Its going nowhere until i say"....why don't you grow a pair and say what it is you want instead of bullshi*ting people?

I thought the way it works is once someone wins the auction you have a contract... am I wrong?
I believe you can claim it was lost or destroyed, so as to avoid fullfiling your contract, but seeing as you have re listed it that pretence would be a very hard to maintain.
If you then decide, once it has legitemately been sold, that you don't don't like the person who bought it, and would rather put it on again for a much higher price, it is basically a breach of contract.
I would be very cautious on bidding on anything from a seller who behaved like that.
Also you leave yourself open to negative feedback surely?
If I had bought something fairly and squarely, and then been refused the item by the seller, only to see it re-listed at almost double the price I personally would complain in the strongest terms Ebay about it. and if possible leave apalling feedback.

I was under the impression that it is, notwithstanding ebay's terms and conditions, there is an implied contract here between buyer and seller and even verbal contracts are binding?
So, in essence, if xmas did not agree to cancelling the trade then he could in theory force Freerange into completion of the contract through the court in extremis?
