with regards to the lottery system, maybe people will have to email in their interest and they put all names into a hat and then hey presto, a winner is pulled out of the hat, just like that. or maybe not.

You know the best sytem was when ripper made a list of 30 on this forum for his crucipods and said put your name next to the edition number you want e.g.
1 2 3
Best system I've seen yet.

FAILED REPUTATION, by carlito on Aug 30, 2007 0:31:50 GMT 1, Hey everyone,
So it seems there have been some big problems with refunds to our international buyers. Can't tell you how bad we feel about this. Gutted.
We had no idea that this would happen, it's never happened in the past through the site and we just weren't aware of this being an issue until now. We feel bad enough with each email coming in from people who were really looking forward to the prints they thought they had received and then found they were being refunded. But now to hear that some people who were overseas are not being refunded fully due to PayPal or their credit card companies keeping a transaction fee for currency conversion, is just a huge problem.
I hope you all know how hard we work to try and resolve anyone who has problems with the site or anything else that involves us. We always try to get back to anyone that emails along with really focussing on making intimate works from the studio. We worked really hard on this print release and were excited to get the work out there to everyone who was interested. So please understand how sorry we are for the hassle everyone endured yesterday. We are simply overwhelmed by this and sorry.
The site was just never designed for the traffic it received yesterday. Yes, we were able to allow it to function to get the work out there but our site wasn't built with any kind of regulating system to stop making it available when PayPal determines something is sold out. It is something we have to do manually. If you put something in your cart or don't keep refreshing the site you won't see that it has already sold out. We just have never had a problem like yesterday until now.
This is why we are moving to the lottery system, you will be able to put your name in the virtual hat and will only have to pay if you've "won" the lottery. This will clearly be much better. We just couldn't get that going for this release and frankly never thought we would be having these problems.
So this is what we are going to do. We are planning to make a brand new limited-edition print for all those who have been charged in this way. This basically breaks down to everyone from outside the country who received a refund from this print release. Sorry to our US collectors, please don't be upset by this. You weren't charged in this way, so please understand.
The print run will be editioned to the exact number of people who fell in this category. It will be a new print made to reflect how bummed we are that our faithful collectors had to go through this and it will never be released again. We will pay for shipping. You may have to give us a little time to get this all sorted, work on the new piece, get it printed and shipped to everyone and there are quite a few of you. But we are on it.
If you haven't received a refund at this point you are probably all set and will be receiving the work you picked out. We will be shipping in the next 2-3 weeks.
The work in the Fall will feature more Originals and some pieces on Wood. It will all be via a lottery so you will have time to think about what you are looking at and make more informed decisions and will only pay if you've "won." Then that will probably be it for awhile we will be focussing on new work for 2008 and really need to spend some time on that.
Thank you again to everyone who showed up yesterday. Please accept our humble apologies in this matter. We are really sorry for the inconvenience and will do our best to make it up to you.
Our best, Faile

How do you think this will work - will they assign a print to each person and then tell them??

Someone cannot just walk away under these circumstances as these terms were not disclosed to all the purchasers. Nice way to try and make it right. Pay Pal really is one of the best scams going.

I'll second that. Pay Pal's actions are absolutely reprehensible.

Sadly, I am one of the US people that got a refund. I never thought I would say this before, but I wish Paypal had screwed me over.

i understand that not getting a print is upsetting but surely you had as much chance as everyone else. Now its a lottery and i think your chances of getting a print have dropped even further as twice as many people will put names in hats as tried to order on line..there is no guarantee they will go to fans and more chance they will be flipped as they are now harder to buy i only hope that banksy does not go this route as i prefer to slug it out on a crap website.
Chill out people its not the end of the world they are prints....albeit expensive ones and there will be another along in a moment

Curley - I completely agree that the fact of missing out on a print isn't a big deal. With supply falling well short of demand a large number of people were always going to miss out. Such is the luck of the draw. As you say, they're only prints.
Though what people didn't reckon on is that they'd lose out on fairly large sums of money by paying for prints they are never going to receive, given the currency conversion, paypal and credit card fees. I'm sure you can understand that people weren't too thrilled to have paid between ยฃ20-ยฃ100 (possibly more) for nothing.
As I said yesterday, I have nothing but admiration for the customer service of the Faile guys and they've always proved themselves to be top of the class. Their offer of a special print to those International buyers who missed out and ended up paying fees is just amazing! I do feel for the US buyers who missed out and won't get this print, but they will not have suffered the degree of financial loss that some of the international buyers have.
As for the lottery system, it's definitely not an ideal solution. Quite aside from the logistics of organising this for Faile. Though I'm not sure it'll result in less genuine collectors getting the prints than the current system, as you suggest. I know a fair number of genuine collectors who'd love to buy prints, but don't have the time or inclination to spend hours sitting at a computer screen pressing F5. At least they will now have an chance at getting a print without the hassle. I truly hope that the new Faile prices will have dissuaded a lot of the out and out flippers. I really don't see there being much of a return for people given the recent faile prices of $600-$1,900, at least not in the short term. There have been plenty of Failes on Ebay in recent months which have gone unsold at or below these prices. Though I guess only time will tell.

I do think faile should keep a record of who they send the prints out to and if they see it on ebay right after it shows up ban the "faithful" collector.

You may remember a little while ago that I did a charity auction and Patrick at Faile was hugely supportive - not only in donating a piece but also in all the emails he sent and the genuine warmth he showed.
Faile really really look after their collectors - witness:
a) the free santa clause print they gave everyone with last year's holiday releases b) what they did with the oversold stuff on the last release in March; and c) this bonus print they are giving to people (at their expense) for the paypal fiasco.
I will hopefully (when it arrives) be able to post pics of something special they have done for me as a result of an order I placed a long time ago that went astray.
I totally believe Faile when they say they had no idea that paypal would screw people over on the currency conversion thing.
If any company should be blamed for this then it is paypal and their astonishing greed. Rather than complaining to Faile it is paypal that people should be directing their ire.

FAILED REPUTATION, by sham69 on Aug 30, 2007 8:54:52 GMT 1, it's easy to spot the ones at the back giving it 'calm down dear, have another cup of tea' when they're obviously the ones who are not out of pocket. Not getting the print isn't the problem, it's losing the cash that's the kick in the balls. We're all grown ups and understood the limitations of the system and the likelyhood over overselling. What we didn't anticipate was the financial loss. Like I said before it's cause and effect. Faile's incompetence, paypal's effect. Can you sell things that you don't have? Can I buy things that don't exist?
Look out for my new site launching tomorrow, 50,000 Banksy originals, choose one or choose the lot. If you don't get one I'll refund your money. Although it may take up to 4-6 weeks for refunds to be processed. Please bear with us.
Oh, but I do think Faile have made the best of a bad job. Yes it was a dogs dinner, yes I'm ยฃ120 out of pocket, no I'm not happy. But the gesture is appreciated.

FAILED REPUTATION, by doughy on Aug 30, 2007 9:11:19 GMT 1, Some already on ebay, fekkers.
I lost out too.
Perhaps an idea for the guys at Faile is for this special launch for us overseas, and be bloody amazed you boo-boys that a "company" will do this for us, is to limit 1 per customer, number/signed to the receiver only, making it special to that one person. Possible?
So if they end up on ebay or elsewhere, it means diddly squat to the buyer, and the orignal person misses out big time on a personalised print. Perhaps part of the print can say "if you bought on ebay, the seller is a dipshit!" too. ;D
Much respect for the level of customer care we are geting from Faile, stop bloody whinging! Me and the missus bought a new houselast year , and the level of service and finish quality is appalling! Trust me, you guys have got it good! 1yr later still not sorted.
If you want to rant at someone, split on the ebay buggers! 1 is in Newcastle I see.
