Bloomsbury Auctions ๐ฌ๐ง, by finsburyparkranger on Nov 29, 2007 15:58:03 GMT 1, I think the Casino hypothesis is a good one. You are buying into a gamble with every sale. Maybe not so much with the slot machines, but certainly at the roulette table. We're seeing that now. It's all down to who can afford to hold their nerve. where's the gamble ? I don't get the analogy
The gamble is that you hope that the thing your are buying today won't be worth less than tomorrow, otherwise you would just wait until tomorrow or just buy from an unlimited edition.

Bloomsbury Auctions ๐ฌ๐ง, by alsbabar on Nov 29, 2007 16:01:46 GMT 1, Manchestermike is correct, the Distance Selling Regs do not apply to contracts concluded at auction - that is a genuine auction however, not e-bay which as explained previously is not legally regarded as an auction.
If what Mike says is correct, then I see some large holes in this issue. It can be argued then that this was in fact an Ebay style auction. When I signed into the Bloomsbury Auction Online, I had to go via Ebay.com to their Live Auctions, and all transactions were completed using Ebay billing. So in essence I used my ebay account for verification and purchasing.
Anyone else share this view?

If that was your philosophy, you'd be living in a cave and hunting your own vegetables
I took a gamble buying a washing machine recently in the hope that it's built in obsolescence doesn't kick in before I've paid it off.
Surely it's only as gamble if you intend to sell. Otherwise the price, value, worth.. is meaningless. Especially if you're not a member of forums or are constantly tracking the prices on ebay.

Imagine if you had a ยฃ70'00 windfall and you spent all that money on art and then you gave it to your son but the time your son got the art it was was worth ยฃ10. I think your son would think you made a pretty poor decision and may consider that you gambled his inheritance.
Happily this scenario is fairly far form the truth.

Bloomsbury Auctions ๐ฌ๐ง, by patrese on Nov 29, 2007 19:19:04 GMT 1, i agree. i remember this time last year was exactly the same scenario. prices started falling through december and january. then lo and behold when february came along with the start of the new auction season prices took off again. worries over the state of the econonmy and over-supply of prints may be part of the problem but i believe that its largely due to a seasonal dip. But this seasonal dip has been going on for a long time. When prices got weak in the summer the excuse was everyone was supposed to be on vacation?!? Then as prices continued to drag even when the fall auction season resumed there were some other excuses and now there is the holiday excuse. I don't think prices are going to collapse. But I certainly don't see any reason to return to the price frenzy of spring 2007. I think prices aren't going to be going anywhere for awhile now. A lot of people bought Banksy prints in the spring and summer and 'd reckon most of those people are flat or at a loss. That's really going to make them think twice about buying anything else on the secondary market. And I'm sure there's still going to be a fair amount of new releases in 2008 to continue to fill the market.
i agree with you...i'm sure a lot of people were wheeling out the "prices will rise after the LA show" line for micallef, and after 2600 prints hit the market, prices inevitably fall, i don't think xmas is particularly relevant at all, prices are falling and will continue to do so...more prints being released & available without an increase in money available to buy them = continuing fall in prices

E-bay is not legally an auction because the sale come to an end through the elapse of time rather than because nobody is prepared to make a further bid. I understand that although "broadcast" via e-bay Bloomsbury was a "proper" auction with an auctioneer who would only bring the hammer down when he was satisfied there were no further bids. As such all purchases would be concluded at auction regardless of how the bids were made and so the Distance Selling Regs would not apply. Hope this clarifies matters.

Maybe a combination of a fragile market, lack of money and possibly Bloomsbury isn't the best place to use when selling this type of art.

I'll be gutted if this goes through for 400-600!
