Banksy Happy Chopper Print, by mattgold on May 26, 2010 23:30:32 GMT 1, I was in the process of being scammed on a Banksy piece I bought off EB... I took the route of finding all the relatives I could including, mom, dad fiancee & fiancees family - then called them explaining what had happened.
As soon as I did and word got back to the scammer, the piece was in the mail. C*nt never did send the COA, but Dora helped me out with that one.
The power of persuasion (and embarrassment) should never be underestimated.

That sounds like a great idea. You could also find out where he works and contact his work colleagues.

Banksy Happy Chopper Print, by rotten on May 27, 2010 1:51:45 GMT 1, wow, i never expected this kind of response..thank you everyone for your suggestions and ideas.
I phoned my bank, and without a court order, all they can really do is request the wire transfer reversal from the UK bank, but then jamie whiteside (jwart) would have to approve it....so you know that's not happening. I'll think about the debt collector idea, but I think he would have to owe me a legit debt and I'd have to have some sort of legitimate case against him going....I'm still not sure that's a road I want to go down. Will definitely give it a think. I mainly just wanted to get this info out to everyone so that no more people would get burned by him.

Banksy Happy Chopper Print, by daveart on May 27, 2010 2:12:40 GMT 1, Definitely push a bit on this punk. call the local police and just request they do a drive by and talk with him. no charges filed yet.. no hassle.. just a quick chat with the authorities and this punk might fold and cry like a baby.
Look you dont have to read this .. so stop now .. but if you do .. this is my experience.. and i share it with you to help save one person the hassle i went through.
Having used Paypal in this situation WOULD NOT HAVE HELPED. Trust me. I bought some 'fake' 'seriously mis represented' expensive art a few years back and used PayPal and thought it was all good. Then the police called to tell me that my address had been found in this guys computer that had just been arrested for selling fake goods. Paypal .. no help AT ALL. Basically paypal does not take any effort in helping with mis represented goods. If goods are shipped at all .. they are happy. This is KEY. They do not warranty goods. If your account is hacked or stolen or whatever. then they help you. DO NOT rely on Paypal to be in your corner to help you with misrepresented goods. period. HOWEVER, and my forum friends this is KEY. IF you Pay your PAYPAL account using a credit card instead of your bank account ... Your Credit card fraud division will kick in. Let me tell you.. after weeks of frustration with PAYPAL. One phone call to my credit card fraud department solved all my problem. Those people are SHARKS. I was reimbursed the full amount plus shipping. If you buy any art online you simply must 1. call paypal to confirm what i tell you that they do not cover mis represented goods. 2. call your credit card fraud department and ask them if the will cover mis represented goods. Only do a transaction where you have coverage for FRAUD. As that is what this is. It is a crime. an intentional crime. not goods damaged in shipment, not a mis understanding, this is a crime.
I tell you one last thing in my sad tale. The product i purchased from Ebay. The police had been monitoring the guys account for months building a case... I was furious to learn this and went back to Ebay Paypal to raise some hell. Oh they confirmed the seller was under watch by police but then told me they will not stop a seller until AFTER a conviction. To restrict a seller prior to conviction would be to trample their right to do business. SERIOUSLY this is what they told me. So even though they knew the seller was under investigation and Ebay/Paypal were participating and helping the police build a case.. they were still letting transactions process through the persons account.
I have bought art from forum members... Ebay ..etc. you have to have some level of trust to deal with people you cannot look in the eye. its a risk we all take. BUT .. i tell you.. dont take that risk thinking PayPal has your back. they dont. Your credit card fraud department though... they are your friend. in my experience of course.
good luck to all. be safe out there. And seriously...get a cop to go do a little talk with MR Jwart. He committed a crime and you just want the police to do a little investigating. That's what they are there for.

Send the print recorded delivery so you can prove he received it. Provided you do not get a satisfactory response then send a second letter informing him that legal action will be taken if the matter is not resolved.
I'm more than happy to help you from this end.

It's nice to know the majority on this forum are good people. My advice would be to try what you can; it is worth a go; take silvermyn's advice, try the c.a.b; do all you can until you have to part with money and see where you get to. Best of luck mate.

You are right, the other side have to approve the reversal of the transfer, but there is a work around that the banks may do with good will: freeze the transaction amount in question on the receiver account until the issue is sorted out. Try to request that to your bank.
Returning the print as suggested may not be an option as, even if you send the print back with tracking and insurance but the seller is a dishonest person he may always tell that the print was not in the package, so be careful with this. My suggestion on this would be to send an email and a registered letter with proof of delivery to the seller ASAP ( I hope you have his address), prior to send the print back. I believe that it will help in any case of future legal actions.
You should also find and contact any local consumer association that may help with advise these issues.
I hope this helps:)

Banksy Happy Chopper Print, by Deleted on May 27, 2010 19:02:55 GMT 1, There's zero chance that a UK based retail bank will look to 'freeze' funds in a recipient account, in fact they cannot.
In the case of misappropriated funds, they have to request the recipients permission to debit the account (except in the case of proven fraud) even if those funds don't belong to that recipient. In my experience, the CAB are pretty useless, although free - and it takes yonks to get an appointment generally.
If you have a case, try the small claims - they're very consumer friendly and quite casual (and cheap).

Banksy Happy Chopper Print, by jackstranger on May 27, 2010 21:13:57 GMT 1, It is not just freeze funds, it is 'freeze' a particular transaction. I was speaking generally as I am not an expert in UK banking
As I understood, in this case it was a transaction from the USA to the UK, what I believe may be somehow different.
Anyway, with my intervention I was just trying to bring up some 'support' thoughts.

Banksy Happy Chopper Print, by jackstranger on May 27, 2010 21:44:33 GMT 1, The only problem I had with an international bank transfer was with a record I bought from German Ebay (generally I always use Paypal). The record arrived broken and I lost my money (it was not that expensive).
A different situation was when I bought design furniture from a site on line. The delivery schedule was beyond the time you have to complaint to the credit card company, so I was on my own. After several emails and unanswered calls I understood that it was a scam. I filled a claim with my credit card company, even being beyond the time-line. So my company sent a request to cancel the transaction to their UK counterpart. The procedure was to receive a reply from the UK company refusing the cancel of the transaction during the next 90 days. As they did not replied I received my money back. Perhaps this was supported by the fact that other persons were being scammed by this company. Strangely... after a couple of years you still can buy on line and loose your money...
