Banksy โข Tesco Petrol Bomb Poster, by irl1 on Dec 1, 2020 16:41:51 GMT 1, Im confused...... If I buy from Sothebys again, do I have to do my own due diligence to see if the piece of work is fake or not ? Sorry to be off topic. If you buy from a an Auction House or a Gallery they have a duty of care to you as buyer, as they are holding out to offer "expert" knowledge and, it is fair to assume, have taken all reasonable steps to ensure the representations they are making are reasonable and truthful. This is covered in law by the Doctrine of Estoppel which states in essence that you will be protected if you relied on those statement and assumptions there from, which subsequently turned out to be untrue. So buying from a Gallery and Auction house you can categorically rely on their statements, unless you could be reasonably shown to have thought they to be false. On eBay or at flea market, less so as you cannot assume that the seller himself has knowledge unless it is unequivocally clear that he is a trader and that that would be a fair assumption. So, here Tate Ward have a duty of care not to make false representations and they must be able to show they took all reasonable steps to prevent making a false statement. Tate Ward Auctions Ltd
Conditions of Sale - Buying at Tate Ward Auctions Ltd
Conditions of sale
These conditions of Sale and important notices and explantation of cataloguing practice set out the terms on which we offer lots listed in our catalogues and online for sale. By registering to bid and/or by bidding on line or at auction you agree to these terms so you should read them carefully before bidding.
Unless otherwise agreed Tate Ward acts as agent for the seller. The contract for sale of all property is therefore made between the Seller and the Buyer.
A. BEFORE THE SALE
1. Description of Lots
(a) Certain words used in the catalogue descriptions have special meanings. You can find details of these on the page headed "Important Notices"
(b) Our descriptions of any lot in the catalogue, any condition reports and any other statement made by us (whether orally or in writing) about any lot including about its nature or condition, artist, period, materials, approximate dimensions or provenance are our opinion and not to be relied upon as a statement of fact.
2. Our Responsibility for our description of Lots
We do not provide any guarantee in relation to the nature of a lot apart from our authenticity warranty contained in paragraph E2 and to the extent provided in paragraph I.
3. Condition
(a) The condition of lots sold in our auctions can vary due to factors such as age, previous damage, restoration, repair and wear and tear. Their nature means they may not be in perfect condition. Lots are sold "as is" in the condition they are in at the time of the sale, without any representation or warranty or assumption of liability of any kind as to condition by Tate Ward or by the seller.
(b) Any reference to condition in a catalogue entry or in a condition report will not amount to a full description of condition and images may not show a lot clearly. Colours and shades may look different in print or on screen to how they look on physical inspection. Condition reports are provided free of charge as a convenience to our buyers and are for guidance only. They offer our opinion but may not refer to all faults, inherent defects, restoration, alteration or adaptation because our staff are not professional restorers or conservators. For that reason they are not not an alternative to examining the lot in person or taking your own professional advise.
E. WARRANTIES
1.Seller Warranties
For each lot the seller gives a warranty that the seller:
(a) is the owner of the lot or a joint owner of the lot acting with the permission of the other owner(s).
(b) has the right to transfer ownership of the lot to the buyer without any restrictions or claims by anyone else.
2. Our Authenticity Warranty
We warrant that the lots in our sales are authentic. If within 30 days from the date of sale you satisfy us that your lot is not authentic we will refund the purchase price paid by you (We would expect at least 2 independent specialists recognized by us to provide written evidence that the lot is not authentic and the reasons for their opinion)

Banksy โข Tesco Petrol Bomb Poster, by tab1 on Dec 1, 2020 16:53:50 GMT 1, Already everyone pulling different facts and raising different points which leads to different conclusions
A full investigation will present all facts , end speculation, clear the auction house if a genuine mistake , lead to the source and clear up any speculation on other items/ posters being fake .
At present can not see any potential new customers knowing of this information willing to conduct business with them at present ?

Buyers should note all terms and conditions of any auction house before bidding. Never buy anything without a condition report and extra pictures of the piece being sold, as it could be a stock picture.
Also always get a shipping quote first, as it can run to high hundreds for a small piece.
Check all the terms in Tate on this lot, by the way it's mine and a real one, I stand over it a 100%

Banksy โข Tesco Petrol Bomb Poster, by tab1 on Dec 1, 2020 17:43:44 GMT 1, Another reason full disclosure may not come from others that have been refunded is as tate had a niche market for selling the lower tier banksy items , which gained a much higher price in their auctions than other areas in the market which members here seemed to use their services hence they are happy with refunds and see no need to progress further . Probably have more items to list ๐๐ The way the market is , it has priced out many collectors in the last two years , these posters are trading for unsigned banksy values from 5 years ago which lets these collectors priced out recently re enter the market at a price they could afford , with this new market virtually to themselves which of recent they were setting new market highs . Time for a new auction house to learn from the failings and make a killing ๐ฌ

Banksy โข Tesco Petrol Bomb Poster, by anic on Dec 1, 2020 19:37:44 GMT 1, I am selling this Banksy Petrol Bomb poster.
It was purchased off ebay within a week of the release, I have lost proof of the ebay purchase as it was so long ago.
Here are some photos of the poster... Happy to provide more photos in order to authenticate etc
There is a slight crease on the right handside in the middle but is not very noticeable at all - just looks emphasised with the bright light. There are a few knicks on the border but all very minor.
Looking for ยฃ3000 - based in London/Hertford. Any questions, get in touch.

Banksy โข Tesco Petrol Bomb Poster, by samir21 on Dec 2, 2020 12:36:59 GMT 1, This is like watching a car crash in slow motion. Tate Ward have clearly, at their own admission sold fakes. Life all auctioneers they have a duty of care to take all reasonable steps to ensure their representations are accurate, again at their own admission they appear not to have done so as the results are there for all to see with them seeking to buy back all of those items found to be fake. Whilst Petrol Bomb is the item that has come to the fore there has been a lot of speculation around a number of the GDP prints in the market as a whole, with whole threads around items' legitimacy or otherwise. I have no view if Tate Ward have sold any fake GDP or other non COA posters, stickers or the like, but if I was them I would to know for certain that I had, or had not. Clearly there is a strong supply chain of these fake prints, and similar non COA items, which Tate Ward have not had processes to prohibit entering their auctions. This is where a police investigation should start, at Tate Ward, Nick (and his related sources) and a number of their consignors. This is about the market as whole and is not about conspiracy theories. What everyone should want is to eliminate the parasitic elements from the marketplace. It is also about help this poor unfortunates, both on this forum, and those who are not, who are naively sitting there believing their treasured work is not only a great piece of art but is nicely accumulating investment for them. In order to restore that magic word "Trust" which Tate Ward refer to in their recent post, they themselves should call the Police in to investigate the situation as it is in their own interest to prove that they have been both innocent in the practise but to help eradicate those who have been guilty of deliberately and wantonly supplying fakes in to the market via eBay, galleries and their and other auction houses. No drama, no fuss just doing the right thing for all concerned who have bought in the past and may buy again from them in the future. Absolutely agree with all of this. Yes finally someone with talking sense

It's funny, I asked the same question yesterday: nowadays, is it better to buy a poster, print or tats, real but damaged, or new and fake? I was desperately looking for my fourth Bristol Museum poster (the one with the cop) and in fact, I found it in another box (ketp flat), with a damaged, twisted, folded corner. There, I asked a restoration workshop to have it repaired, but hey the corner is damaged and we do not work miracles (especially on thick and glossy paper).
ps: the worst would be to buy a rotten or damaged object and in addition, false ahaha! Finally, I too had pinned or taped posters of the Rolling Stones or Pistols tours (some are still on the wall, however I think that time is playing out and buyers will be more indulgent and will give a good price if the print or the poster are rare or / and old ...
(like old papers ... Beware of mint, collectors, I know that in England and elsewhere, you like this term a lot, but too mint, hide or can hide faults (fakes for example)...
I wish a print of Banksy even a bit spoiled, but real and singed by his hands !

Banksy โข Tesco Petrol Bomb Poster, by JFCC on Dec 2, 2020 14:47:31 GMT 1, I am really not sure why Tate Ward are not stepping up to the plate on this?
There is a market wide problem which they are a part of, they know it effects a lot of innocent people (their customers), they know and have admitted that their business practices have been lax and as their business is based purely on trust and reputation it is astonishing that they seem content on just keeping quiet and hoping it will go away?
There are two routes they call in the police to investigate and they tell them what they know or, a customer who has been sold a fake does?
To me it's obvious, they clearly have connections to some serial "fakers" in the market and it would be in everyones interest to reveal them so action can be taken against them. It would also be sensible if they seriously look at what else they may have sold historically that may also fall in to the dubious category to preempt the next fake scandal that is sure to follow. It is a reasonable assertion its not going to be limited to just this one item!
I am also surprised this has not been passed to the press but I am sure its only a matter of time before the Daily Mail have it which would be a PR disaster and would seriously hit the values in the market.

All summarised in your conclusion. not limited to just this one item. An investigation will open up a can of worms As they hold the market for banksy posters this may lead to other items being discovered to be fake as an investigation will cover all items sold through the auction house . As this scenario is just known about on this forum will not damage the market . Damage limitation ๐ค

Banksy โข Tesco Petrol Bomb Poster, by daniel3886 on Dec 2, 2020 15:59:57 GMT 1, Would of thought tate ward would ask to destroy the fakes that they have refunded if not asked to be returned ๐
All clients are being offered an unequivocal refund firstly. If they wish to have it inspected then we will do that covering all costs Any that are found to be fake will be destroyed.
There are 14 sales in question. I will update here once this matter has been resolved.
Consigners details are not public domain so cannot be shared openly. Until the authenticity of each poster is confirmed I feel itโs unproductive to speculate any further.

All owners will be asked to return items that are being refunded. This is purely so we can guarantee they are destroyed and taken out of circulation.

Banksy โข Tesco Petrol Bomb Poster, by medichead on Dec 2, 2020 16:24:33 GMT 1, Danny this is a good development and am very reassured to see how your company is handling this.
I'm not a forger, but I can't for the life of me understand why anyone would try and sell copies of a poster that don't even colour match the original.
