Cartrain π¬π§ Tate Gallery β’ Damien Hirst β’ Gilbert & George, by Daniel Silk on Sept 8, 2009 15:24:19 GMT 1, You would like to think wouldn't you Silky that you cannot be made accountable. However, given that Hirst's lawyers have imposed a ban on Cartrain from posting on forums (which i would presume means this one), then you can be sure they are aware of this forum, and are aware of you owning it, after all, all you need to do is a little research and you can find out who the owner of this site is. Trust me, you can be cited as an acccessory - there is enough evidence on this thread alone to support (not taking in to account the other threads) any possible action against you.
You have let your imagination run away with you The law is based on facts! not false information posted by people on internet forums.

Stating a fact to you, isnt imagination. Common law is also based on moral responsibility, which you seem to forget you have when you created this site and earn money from

Cartrain π¬π§ Tate Gallery β’ Damien Hirst β’ Gilbert & George, by dudebro17 on Sept 8, 2009 16:01:03 GMT 1, if you have a vested interest in this kid doing well, and you provide a stage (forum) for him to promote and sell his wares, then yes you can get yourself into some trouble. Much like the guy selling fake LV bags on the street. He may not have made them, but if he gets caught selling them, watch out. If I were you, I would delete all that kids contributions to the forum and sever all ties. Whatever you stand to gain from his success is worth far less than the headaches that could come your way.
Looks like you may have been banning and deleting the wrong members and posts all along.

Cartrain π¬π§ Tate Gallery β’ Damien Hirst β’ Gilbert & George, by Daniel Silk on Sept 8, 2009 16:03:48 GMT 1, but you are just as culpable silky, firstly for encouraging him to do so, by alllowing him to post his intentions and actions on here, and secondly for allowing his gallerist to promote and cash in on it here also. So you could potentially be cited as an accessory before, during and after the fact
"firstly for encouraging him to do so" - False, you probably knew about it before me.
"by alllowing him to post his intentions and actions on here" - This is a forum with over 9,000 members, and they are all responsible for their own posts and actions, including you.
"and secondly for allowing his gallerist to promote and cash in on it here also." - See above.

So the bloke who sweeps the pavement where this fictional person was selling fake LV bags could be taken to court? I had no idea the legal system in this country worked like that.

Anybody knows if Hirst's asked autoritation from the original owner of the skull?
Maybe is a interesting point for the trial...

No they cannot, that comment would be defended by the "Fair Comment" ruling,
"The defence of βfair commentβ is closely related to justification. This defence may be available where the offending statement is a statement of comment rather than fact, is based upon facts which can be proven to be true, and is made in good faith, without malice, on a matter of public interest. Again, a web publisher will often be in a poor position to assess the applicability of a fair comment defence in relation to a statement made by a website user."
if the Government persist you can defend it with the Reynolds style privilege,
"In addition there is a special public interest defence (sometimes called Reynolds-style privilege) which could in principle be applicable. However, the scope of this defence is uncertain, and it is not entirely clear how it may apply to website forum or blog comments."

I canr remember what I agreed to when i signed up, but there would have been some legal jaronese about owners responsibility blah blah
You( Silky ) were not aware that a pre - existing member had an agenda nor were you aware that when he began to post, he may well have been defacto admitting or not that he was involved in an act of criminality - at the minute, this has yet to be heard in court, so obviously we all have to be careful what we say - an ill placed comment could be used by the filth in extreme circumstances - monitoring This thread will hardly be a top priority for the CPS, though they may well use some of the accused postings in a case - if they can be bothered - this is hardly Brinks Mat in scale
promoting dicussion and allowing people to speak is the basis of art and the basis of this forum. Thye are ultimately responsible for their actions and words
to demand removal of posts is more stasi than street and a shame on those who seek to curtail discussion.

Cartrain π¬π§ Tate Gallery β’ Damien Hirst β’ Gilbert & George, by artstylee on Sept 8, 2009 16:45:51 GMT 1, Cartrain is either doing way to much. or maybee just enough to cement a place in art history at an early age. Really putting it all on the line w/ his street/gallery moves.
Maybee he should have just let it die after they(Hirsts team) legally jacked his collages that he was trying to get people to believe Hirst purchased from him.
Although I do like the spirit of the little tike ("you take my stuff/ I'll take yours"). I think his stepping out of his league going the extra step to ruin a piece of Hirst's by stealing from it. (If I was Hirst I would have already fixed the piece by putting/replacing the pack of pencils)
To each his own, but this little buddy is going ballz out for his art. At this point I'm not even sure if he's done enough work or developed a style which allows him to legitimately claim he's an artist.
Bottom line is that a youth watched way too many Banksy you tube videos. Thought he'd insert himself into the mix w/average level collages, and copy cat You Tube Videos. Now he's got himself stealing from wealthy art collectors.
Where is cartrain's parents at??? They need a good whoopin'

Cartrain π¬π§ Tate Gallery β’ Damien Hirst β’ Gilbert & George, by Daniel Silk on Sept 8, 2009 16:48:22 GMT 1, From February this year - www.independent.co.uk/arts-entertainment/art/news/god-save-the-damien-hirst-ripoff-industry-1608219.html
"Creators of the website redragtoabull.com, who include Jimmy Cauty, a former member of KLF, Jamie Reid, best known for designing the Sex Pistols' "God Save The Queen" single cover, and artist Billy Childish, have produced a series of skull images which flouts copyright regulations and deliberately provokes one of the most powerful β and richest β artists alive.
Writing to The Independent, Cauty said: "Unlike Cartrain and his gallery, we are not intimidated by lawyers and if an injunction is issued, we will simply ignore it on the grounds of freedom of speech." He suggested the concept of copyright, which was changing in the music industry, had some way to go before it was "abolished and replaced with something more flexible".
Reid, meanwhile, called Hirst a "hypocritical and greedy art bully", adding: "Hasn't he got enough?""

Cartrain π¬π§ Tate Gallery β’ Damien Hirst β’ Gilbert & George, by schlomo on Sept 8, 2009 16:48:49 GMT 1, theres a difference between a fake and copyright infringement. At no point did Cartrain make a skull similar to Hirsts so really no comparison to the selling of fake anythings.
Anywho, Bono i couldnt agree more with everything you've said. I would also say innocent until proven guilty peoples. As far as we know it could be a huge fake publicity stunt, Hirst could be in on it, so could Cartrain. Infact that wouldnt surprise me one bit.....
