David Shrigley - Be Nice, by volvic on Feb 17, 2018 17:08:03 GMT 1, The artist always chooses a natural wooden frame for his works which I think works particularly well and think itโs nice to stay in keeping with an artists specification.
If not just a simple white frame with white background or black wood

David Shrigley - Be Nice, by robo on Feb 18, 2018 0:07:20 GMT 1, I keep going back to the Schafer Grafisk site. Some really nice stuff there at good prices. Liking this one (good-sized for a picture of a bunny, 75 x 56cm). Linocut and etchings are such sincere, direct, art-making techniques. I ordered one of these and it arrived today. Lovely print!

David Shrigley - Be Nice, by Pavoni on Feb 18, 2018 5:22:29 GMT 1, Shitty experience with Counter Editions on this, attempting to buy Be Nice.
Details for anyone who cares:
Carted at 1800, checked email a few times for coupon. In that time saw price changed to 2,000. Absolute max I could afford.
Carted at 2,000. Took about 90 seconds--2 minutes to fill out form. The price stayed at 2,000 on my screen (R side, ship & pay information on L side) entire time I filled out.
Click pay, all good. Congratulations! Etc. Yay!
Go to receipt to print screen shot for my records. 4,250 GBP !!!
WTF!?
Email them, unacceptable and impo$$ible. I agreed to our contracted price of 2,000 as was listed on your website during entire checkout process.
Basically tell me they charged me 5,000 GBP tier, to fck myself at 2,000, and they will cancel the order.
Is this SOP for tiered pricing? Behind the scenes and unbeknownst to buyer the price rises faster than meat in Caracas?
Understand the concept, prices rise as orders come in. My order was in.
Disappointed and somewhat furious about this.
Any insight or experiences welcomed.

Have seen some in-person books and things with "D. Shrig". Which I like, personally.

Never happened that way before. Many sites give a 10-15 minute transaction-completion window, during which time you essentially have right of first refusal at that price.
Seems deceptive and manipulative, the behind-the-scenes price inflation.
I was acting in accord with what @romulus said above.
Thanks for your input.

David Shrigley - Be Nice, by mistergum on Feb 18, 2018 11:41:25 GMT 1, That happened to me a couple of times until my transaction went through, it seems there was such high demand it temporarily seized up the website and in the meantime other trades went through. Interesting phenomenon for some new editions, bit of luck of the draw I guess. I have dealt with CE in a number of occasions through the years and found them nothing but professional and helpful. I have a couple of their Humes which are beautiful quality and Vicious is still available at tier 1 or 2 price I think, float mount framed in white itโs a terrific print

The Terms and Conditions of the Counter Editions website address this situation under 'Pricing':
countereditions.com/terms
At those times when we are experience [sic] high demand prices are subject to rapid change. As such the price for an edition already in your basket may change during the shopping and checkout process. The actual price payable is the price at which your order is accepted and confirmed.
You will have accepted this provision when you clicked the box 'Agree to Terms and Conditions'. Whether it's legally enforceable is a separate matter.
__________
Here, it wasn't a simple case of offer and acceptance. The offer at ยฃ2,000 looks to have been terminated โ revoked by Counter Editions minutes or seconds prior to its acceptance by you. [It's also arguable that this wasn't even an offer, but rather an invitation to treat.]
What's noteworthy is the fact you appear to have had zero indication of the price jump (from ยฃ2,000 to ยฃ4,250) at the time you clicked the 'Place Order Now' box. That's messed up. An agreement cannot be entered into if one of the parties hasn't received communication of contractual terms having changed. Valid consent requires knowing what you're consenting to.
Given the ambiguity, this would make an interesting legal case. I don't know how an English court would opine if you were seeking to enforce a sale for ยฃ2,000. The cancellation of your order and refund might already be deemed a sufficient remedy.
__________
Legalities aside, your description indicates the Checkout system for Counter Editions is wholly inadequate. It's preposterous that a buyer discover how much they were charged for a purchase only after the funds have been debited from their account.
However, I don't believe there's been dishonest intent by Counter Editions. So I wouldn't use your description of "predatory" when referring to the company's behaviour. "Unfair" seems more accurate to me.
I'd be curious to hear the artist's feedback. Getting Shrigley onside may be your best chance for achieving a satisfactory outcome.
Good luck.

David Shrigley - Be Nice, by nighthawk on Feb 18, 2018 16:24:20 GMT 1, Yes, this is how Counter Editions has always worked. For a sale like the Shirley, (any print that is going to move quickly), the final price may have jumped a tier (or two or three), after you hit the final pay button. Had you refreshed the last page, you would have seen the price had changed. But obviously nobody is going to refresh the last page, and it could still change after that, so it's sort of a mute point.
The fact that they offer to refund your order immediately means that they're doing all they can in instances like this. It sucks for sure, but it is what it is...I guess

Legally binding?

Would love this to be true
Do you have all the info to take this further?

My understanding too. To have a binding contract there has to be, amongst other things, an offer and an acceptance. I believe, although I could quite easily be wrong as Iโm no expert on such matters, that putting a price on something is not an offer that the buyer accepts when taking the item to the till to pay. Putting a price on something is, I believe, an invitation to tender. The customer makes an offer to buy at that price when taking the item to the till, which the shopkeeper accepts when taking the payment. How it works online I donโt know. Perhaps itโs subject to the Distance Selling Regulations, but I donโt know what they say, other than providing a cooling off period in some circumstances. I do think itโs bad that the price increased without the buyer knowing. It could have caused him/her to be substantially overdrawn. He/she should have had the option to decline the much higher price.

David Shrigley - Be Nice, by robo on Feb 18, 2018 21:08:47 GMT 1, I think if you cart something at one price that is what you should pay. Counter Editions seem to use an antiquated system which is a shame given the money theyโre making.
Itโs actually not antiquated. Itโs cutting edge. It was just designed to work this way.
