There is the argument that something was not correctly labelled as art but again unless you specified this to the seller then again it kind of falls back on you. I wish Iโd ensured the gallery had listed my item as original art but instead it was marked as โDecorative/ Sculptureโ so from that perspective Iโve lost the fight. Youโd hope galleries would know better by now but when purchasing from a different country descriptions can get muddled and then we get screwed. Iโve opted for DHL to send the HMRC amendment on my behalf, itโs ยฃ45 I shouldnโt have to lose but my time and stress levels are worth more than that and if it reduces my bill from ยฃ173 to ยฃ85 including this fee so at least Iโm better off ๐

Eventually I got the correct invoice and the โfineโ cancelled. Try and escalate it. Ask politely to talk to the line manager of whoever youโre talking to and try and keep it civil and theyโre generally more responsive.

One thing on your side, my experiences of calling to sort this i seem to remember being easy with DHL. IF it was fedex/tnt it took me a year to get them to sort it. Call them, they will probs just adjust it for you.

My advice would be to treat them like idiots. Tell them exactly word-for-word what they need to put on the customs declaration form, including item description and the import tariff code, often referred to as the HS code. For prints, this is 970290. For sculptures, it is 970390. You should then hopefully get the 5% tax applied rather than 20%.

In addition to that how much import sales tax and customs do I have to pay in Germany? Is there a way to get the payed VAT back?

As mentioned the courier company work out and charge the VAT and import duties. In my experience, it's difficult to get an exact cost from them and because I returned an item, it took 8 months of emails to finally get them to return duty owed. Never again.

Key here is that the Commercial Invoice is correct, and should be zero rated as you are based in Germany.
On the Commercial Invoice, should clearly state the Tariff Code for the item correctly, so that you then pay the correct amount of Customs Charges when it enters Germany.
It may be worth calling the auction house to clarify, I'm sure its not the first time they would have done this - all the best with sorting.

No matter what tax code has been put on there, if they're limited editions it should be 5% and that's all you owe. I've had issues in the past but got it sorted.

When the item is described as "fight for a dream" then you are asking for trouble! It could literally be anything! Which is the point I was trying to make above Mooncub. The onus very much on the seller, i.e. the gallery to complete things correctly. I deal with international shipments at work (not art), and all boils down to the Commercial Invoice raised. Very specific what you have to put on here, as mentioned, Tariff/Commodity Codes, values, contact details of receiver, and certain statements. You should easily be able to check this before sending, if I was buying from abroad, I would definitely ask to see it before they upload to DHL/TNT etc, surely this would save a whole world of pain. If this not done correctly, I can see why the carriers applying different import/export charges. Hope you get sorted funnyfarmiom. Worst I got was a gallery sending me a giveaway and putting a value of 90 GBP.... while items were available in their shop at 45GBP. Never understood why they did this, they were may be hoping custom agents to buy from the shop next day thinking they had a deal

Trouble with that Topper is that the shippers are only going by what has been put on the Commercial Invoice.
This more often than not uploaded onto the shippers portal.
They wont be checking the parcel to see if its a limited edition, they will simply go by the paperwork.
So if the code/details wrong on there, you will get charged incorrectly.

It took months to sort, but I kept photographic evidence of everything and I badgered them so when they chased me I could prove I was chasing them (this is what helped me win my case). The entire company is useless but they will back down if you prove you are right.
