Charidee Complete & A Big THANK YOU!!!, by Harveyn on Feb 21, 2008 19:45:36 GMT 1, Please note that I have finally had enough with respect to last years charidee. I do apologize but I have informed Helen at Bluebell that it is now up to them how they want to proceed.
I have one piece of work that was donated by Frankie @ Campbarbossa which I will auction and send the money directly to Bluebell.
I have tried my best to get these auctions run smoothly and efficiently. I have found myself being the buffer between the outside world and Verbal and his communications with me have been as poor, abrupt and infrequent as they have with them.
I ensured with the help of Bluebell that the first lot of monies owed was paid and I can assure you that was not easy.
Apparently over ยฃ3000 worth of auctions have not been paid. I have been unable to substantiate these facts as Verbal refuses to let me know which auctions have been concluded successfully.
All I can add is that a number of people have contacted myself and Bluebell to complain about payments made, no communication as to how to make payments and every other type of imaginable failure. This has lead to paypal disputes, paypal account closures and complete and utter chaos.
I have attached the last communication I received from Verbal today and my response. I do this as a last resort and so the people who have donated art or won auctions can decide how to proceed for themselves.
I have highlighted the comments that have lead to my decision to remove myself from this process. I think you will understand. I am not prepared to be threatened.
Verbals email today
"I will not ship any items to you. You can pick them up. That way you will know what has been sent and what has not. I have never sent you an abusive email or spoke to you in an abusive way.
I emailed every single person at the end of the last set of auctions and explained that paypal was no longer an option. Is it my fault that payPal closed my account and robbed me of 27k?
This is the way it will be neil (I really do not know why you feel you can boss me around or why you feel this is your endevour and I am your subordinate, but I am the boss, I am in charge, not you. Make as many demands as you like neil, and threaten whatever you like, but the simple fact is that you are in no position to demand anything of me, we have no contract, no agreements. This endeavour was my idea, and therefore I am in charge, not you.
If you want to collect the rest of the lots and auction them then be my guest, but you will do it at your expense. As for the re listed item, I will tarethe cheque up unless he retracts the negative feedback he left. My london address is registered on that ebay account, so he could have sent a cheque weeks ago. If you want to sell the items I will officially wash my hands of the whole thing, pay any outstanding monies to helen (like I did last time and was called a liar and put through hell because of their incompetence) there is about 400 outstanding from me and about 3000 unpaid items. Alternatively, I have the week off and can list all the items and instruct people to pay the cash into your paypal account or send you a cheque. You will owe me a tenner or 20 for each item to post them.
To close neil, you are not in charge, you have no right to demand anything of me and I really am looking forward to you getting into the legalities of this situation, because I have and to cut a long story short, you are nothing in this situation. Your involvement is at my pleasure, not yours. Don't push me neil, you were rude to my family and if you really want to see what happens when my utter contempt for you explodes then I suggest you continue with this 'hostile takeover'.
All I have to do is sell the items and give the money to bluebell, I can do this at my leisure and in whatever way I choose. If the individual donors want their unlisted items back they can request them from me and I will gladly return them. I never appointed you MD of these auctions, you appointed yourself, as far as this auction goes, I am your boss and you bloody well know it, so you don't tell me anything neil, I tell you what to do. Understand?
Now I am happy to keep you involved as you selflessly gave your time and have amazing organisation skills, but I am telling you neil, do not think you have any authority over me, either morally or legally and if you wish to communicate with me you will do so with respect.
Absolutely seriously"
My response today
"Dear Chris
I have copied Helen from Bluebell on this mail so she and Bluebell can witness your response.
I am officially bowing out of this process. I have no wish to be involved any further. I will post your response on the forum along with my retort. This is necessary so people can understand what has happened.
From day one you informed the forum that you were auctioning a diamond for charity so people could bid for a very good cause. Several members offered to donate a few things and I suggested we run an auction of pieces donated from galleries, artists and members. I then apologized to you for lumbering you with this work load and offered to run the auction. You said you would be more than happy to run it and I could help on the organizational side.
I had no wish to make a hostile takeover and it is your poor communication with countless people that has lead to this predicament.
For you information and as stated very clearly in my communications it is Bluebell that will take further action and not myself.
I have never once been rude to your family and it is your abrupt responses and use of profanities in the past that I alluded to. You may not find this abusive but I do and it is not how I conduct myself."
Regards

Charidee Complete & A Big THANK YOU!!!, by loucastel on Feb 21, 2008 20:04:32 GMT 1, I think the overall consensus of this forum is that you have done your very best for all concerned, so no recriminations are warranted whatsoever. can understand why you have decided to bow out, it is now up to all the people who donated stuff to decide what to do. Call in the filth methinks!!

Charidee Complete & A Big THANK YOU!!!, by Michael Jacob on Feb 21, 2008 20:14:30 GMT 1, Neil, You know Ive PM'd you many times telling you how patient you have been and how well youve handled things. What Verbal has done is terrible, and it's a shame to have you associated with it in any way... other than positive. You did a great job!
Verbal, you're a piece of crap in book! There is NO excuse to your actions.

Charidee Complete & A Big THANK YOU!!!, by Michael Jacob on Feb 21, 2008 20:24:44 GMT 1, gozgoz I agree with you 99% of the time, but this is an exception. Forum members who know me, know that Ive always been positive and supportive. This situation is wrong, and what Verbal did is wrong. There is no other way to look at it. Judging by your posts, youve been around a while and Im sure youve seen this unfold. Its been a disaster since it started. Neil did a great job and took alot of heat from forum members, and ALWAYS held his chin up. Verbal stood behind him like a coward. He had countless opportunities to address Neil or forum members but chose not to. This is not a lynching, it just people venting. Many people donated artwork and money to a good cause.
I agree theres to much negativity and Im done venting. Have a great day!

Charidee Complete & A Big THANK YOU!!!, by dotdot on Feb 21, 2008 20:43:13 GMT 1, I remember back in the day when Verbal had his troubles and problems - and i remember clearly the support he engendered from this very forum.
From there the idea came - which was fine one.
Alas it mushroomed somewhat into a job a collection of tasks and a whole raft of confusion , confusion and latterly resentment and more confusion.
Whilst I'm sure this was not anyone's intention - floating an idea which quite a few others hook up /donate / subscribe to - doesn't give anyone flexibility to simply not deliver.
It's a good story with its intention - don't get me wrong - but in the end it's a bad story because the ending is how it will be remembered.
Well done HarveyN - you tried your best - and were browbeaten by someone we now might not want to know. You on the other hand mate - if i ever meet you - it'll be my round.
cheers

Charidee Complete & A Big THANK YOU!!!, by pezlow on Feb 21, 2008 21:15:33 GMT 1, Harveyn whilst I can understand your desire to walk away from this unfortunately verbal has held himself out as auctioning these items as part of the Banksy.info forum. Many non-forum members have no doubt bought pieces believing them to be for a legitimate charity and have not received them.
I know of one person, a friend of mine, who bought one piece and sent a paypal payment to verbal over a month ago. No art received, and only the occasional waffling apologetic email from verbal promising to send it the next day. So far all promises have been broken.
Sadly this brings the good name and reputation of this forum in to dispute. It seems to me that the only way it can be resolved if for someone from the forum to make contact with each of the successful ebay auction winners to see what has happened and to encourage them to file paypal disputes and chargebacks to their credit cards as soon as possible, so that their purchases are protected.
Though I appreciate that you wish to walk away from this in the good name of the forum someone needs to try and sort this unholy mess out so that the forum's reputation is not damaged.

Charidee Complete & A Big THANK YOU!!!, by a4mnt on Feb 21, 2008 21:28:15 GMT 1, what a surprise of the breakdown between payment and receipt.
hasn't this been coming for ages?
looks like you've done the best thing Neil by distancing yourself as no doubt the situation will clear up as quickly as a dose the clap.
on a brighter note, i was thinking of organising a forum holiday. if everyone just sends a cheque to my maldives address for ยฃ900 then i'll get it sorted.

Charidee Complete & A Big THANK YOU!!!, by Harveyn on Feb 21, 2008 21:47:04 GMT 1, Pez - Honestly I have tried and I know you know what I have gone through to try and get this resolved.
No communication, abrupt responses, swearing and now threats.
Numerous people know what has happened some of which I cannot repeat on this forum. I have defended Verbal when his actions were indefensible. I did this just to try and get this process to run smoothly.
Helen from Bluebell has been a star and believe or not she has had to deal with people directly who bought items and were complaining about not getting pieces or payment issues.
GG - Your sentiment is 100% correct but I genuinely felt people needed to know so they could make up their own minds what to do.

Charidee Complete & A Big THANK YOU!!!, by seidbereit on Feb 21, 2008 22:33:54 GMT 1, I'm totally gutted for you Neil that you've had to take this step as yours was the only information we were getting over very long stetches (and I won one of the auctions, paid, and fortunately finally received my item, so know what I'm talking about). I fully support your decision and thank you for the time and effort you've put in.
Really quite astounded by verbal's response to you - I've no idea what to say, just so sorry you had to be on the receiving on of it.
Agree also with pez. The incompleted auctions need to be dealt with by someone as a priority. Verbal is quite patently not up to the task, or to even communicate in a civil manner apparently for that matter.
Someone in London (where I assume verbal lives/has the unsold items) also needs to get over there and collect the whole lot off him and ideally finish the auctions without him as verbal obviously seems to think this is more about him than the charity cause itself.
Truly sorry mate.

Charidee Complete & A Big THANK YOU!!!, by stuey09 on Feb 21, 2008 22:49:46 GMT 1, Just read through the thread Neil.
I know how much effort that you've put into this and you've done well to stick at it this far. Well done mate for a stirling effort.
Verbal if you read this, I'd ask you to think about the spirit that this gear was donated and for you to do the honourable thing.
