If that’s the case then I agree, they should have noted your displeasure at the proofing stage.

If you've ever spoken to a lawyer you'll know that they will never, ever offer you a definitive statement regarding the law, only an opinion. I have to deal with legal people on a regular basis — we have a legal team at work — and my dealings with them have led me to understand that no one can accurately predict the outcome of a particular case. Team Banksy obviously felt they had a reasonable chance of GDP resulting in a successful trademark defence, but it would have been a calculated risk and the lawyers would have known the outcome was uncertain. These things happen because the law is interpreted by judges based on often conflicting precedents and legal arguments, and because they have the ultimate power to interpret it as they see fit. The bottom line is that obtaining the best legal advice and following it to the letter is no guarantee of a successful outcome. Lawyers will "never, ever offer you a definitive statement regarding the law"...? They should do, as legislation at the very least is in black and white.
In terms of predicting whether GDP would help Banksy protect his trademark, it was not too difficult to predict this outcome. It failed. I'm not an IP specialist but even I expressed doubts about whether the cloak and daggers "lottery" concept was the same as selling things to the public (see my comments from November 2019 on the GDP thread below, just about half way down the page).

The lack of a genuine commercial initiative was a key issue mentioned in this ruling. The online shop didn't pass even the most basic sniff test. If a QC specialising in IP advised that it was a good idea to go public saying that you're only making stuff for the "sole purpose of fulfilling trademark categories", run a commercial enterprise as a lottery and select winners based on answers to a question (seriously, how many businesses sell products to the public in this way?) then that really wasn't the best legal advice. I'd be surprised if there was any legal argument or precedent supporting that unique approach to running a commercial enterprise.
Getting the best legal advice from a top specialist in the relevant area of law, and following it to the letter, should achieve as close to a successful outcome as anyone could hope for. That's why you pay the big invoices. You out-lawyer the opponent. It won't, however, guarantee a win as it is well known that you can't generally polish a turd (as they say) although there are some exceptions to even that saying.

GDP pretended to sell unlimited editions to the public but it was all a lottery, answers to a question, and no unlimited merchandise in the form of t-shirts, mugs or plates unless you were "selected" to buy one of the small number available. If they want to change that they can, but they won't because selling cheap merchandise is not what they want to spend their time doing.
The Soup Can posters for £10 each from POW was the first example I can remember of cheap unlimited Banksy product and we've seen a similar model followed with Peckham Rock. It all just went a bit off concept with GDP. Will we ever see anything like the Soup Can posters again? Unlikely but you never know. Dropshipping is a thing now.

Take 20% plus vat on the premium off the hammer price plus other fees and the net to seller prices aren’t as spectacular with the exception of a few lots. Reality is it’s the auction house that wins as they get from the seller and the buyer. I've never really understood this. As a seller lets say I have a copy of a print that a buyer has just paid Christie's £100k for. Obviously the demand is there. When I come to sell my print why would I market it at say 20% less than £100k when I know there are buyers out there paying £100k for that print? I appreciate you have a level of security with an auction house but we've recently seen auction houses selling high value prints with pending COA's etc. What exactly am I lowering the price of my print by 20% for?
Genuinely interested in people's thoughts...
*Obviously appreciate the argument that auction houses have overheads etc and will be marketing your print to a degree, but if I'm doing all that work privately why should there be any deduction from the top end price?
Edit* Having read your comment back I've also realised you weren't specifically talking about people selling privately but have always been interested in other people's opinions.
The buyer pays the hammer price for the print. The additional commission is simply for the services and assurances that you get when buying from a reputable auction house. Remember that they do inspect the print, prepare a condition report, and that forms part of a detailed and formal legal ageement between the buyer and the auction house.
If you offered me the same print as Christie’s just sold for £100k for the price including commission, then I’d be wondering why I’m paying you commission when you’re not providing any of the services or assurances that I’d get from the auction house. Similarly, I wouldn’t expect to pay a private seller the VAT or ARR charged by an auction house.

Im not talking about the financial aspect when i say that one of those blows the socks of a Banksquiat if framed and hung.. A superb version of the print Excellent points! I had not even considered that Kate Moss is a more of a UK draw..but you're likely correct! Although, the Warhol connection is why I rather like that design. The UK angle has held a few pieces back in the past.
Tesco’s isn’t a familiar brand in the US. In the past this has held back prices of the Banksy Soup Cans despite the Warhol design connection. Tesco has also had a negative impact on Very Little Helps prices in the past.
By “in the past” I actually mean before buyers lost the plot. These days the market has become a tad irrational and people seem to be paying crazy prices for any old image even if they really don’t get it. In a few years time when things settle, IMHO the Banksquiat will be more sought after than the Kate.

Is the Basquiat connection a big enough draw to equal out the lower edition number of Kate? Any of you owning a Kate or Banksquiat that might consider making this trade? If not, why? If so, why? I'm just posing a query to see where member's thoughts are on this possibilty. Any other Banksquiat straight trade considerations? Unless you have a particular fondness for the Kate, I’d stick with the Banksquiat. IMHO the market for a Kate is going to be quite UK focussed whereas the Banksquiat has more appeal to International buyers, particularly in the US.

The rescue initiative in the Med has been going on for some time now. So that aspect, and the legal complexities, remain unchanged.
The only new thing is that they were given a better boat and renewed publicity. Full credit to Banksy for lending his support in this way to an ongoing effort to save migrant lives in the Med.

I found a couple and I am gonna keep not in perfect condition. It was a great suggestion. I get where your is coming from but please get a second opinion from a second conservation framer. With second hand frames you can’t be sure of condition or quality, and it would be such a shame to see what is arguably one of Banksy’s best prints get damaged.
If you’re happy with the quality of the second hand frames do get the framer to double check. The glass needs to be new and museum standard. Don’t cut corners with the glass.

All you can do is see if they will refuse you when people are on your boat. It’s a big risk but hugely honourable, especially when the alternative is to leave the boat at dock or just do nothing. Best of luck to all involved and fair play to Banksy and co for bringing the specifics of this issue to the forefront. It’s quite a bold move but it has my full backing. It would be quite interesting to see how many people in the UK would give their “full backing” to Banksy sponsoring a boat to rescue migrants from the Channel and bring them into UK waters seeking permission to dock. Anonymous poll anyone...?

Hoping the experts on here can inform us all. Few that come to my mind straight off that may have are are rude copper, Choose Your Weapon white with red dot, Napalm with colour... Was the Dumbo VIP print hand finished? Thanks Worth mentioning that a limited number of both the signed and unsigned versions of Rude Copper had some hand finishing.

Not sure where that came from but I can assure you that I'm not jealous of someone winning the helmet. I didn't enter to win any of the editioned originals because I wouldn't know what to do with them, apart from sell them and I didn't enter to make a quick bit of cash. I'm a prints guy and entered for a Thrower. I didn't win one and am not jealous of anyone else who did.
I own a number of pre-2006 prints and recently sold a signed GWRB, not because I needed the cash but because I fancied a change. If the Thrower looks as good in the flesh as it did online then I will buy one on the secondary. To me it's a luxury I can afford. Not trying to rub it in but just so that you know that it's not jealousy.

Some people on here will try to make out that Banksy signed the helmet, that Banksy executed the street piece and that the mistakes were intentional or normal for the artist to make.
