Anyway, I just understood something these days ( nothing to do with vat etc ) : why now galeries send even a little letter by DHL, FedEx, Ups ? Because they has really preferential prices and arrangements with customs... So, they tax buyers ( shipping customs etc ) It was not like this before .. What a mess ! I think another part of the problem is galleries / sellers not understanding the impact of using the wrong commodity code or not describing the item correctly on the customs form.
So if a print is described as "art print" instead of "hand-pulled, limited edition screenprint" the couriers have to put it through customs as a print/poster and it gets charged the full VAT. The same problem happens if something is described as "merchandise" (yup, that's happened to me before!). That also makes it harder for buyers to challenge the import VAT decision as the customs declaration description doesn't match the sales receipts etc.
If the buyer can communicate with the seller before shipping to let them know what to put on the customs declaration (within reason of course - you can't ask them to just put anything ๐) that (theoretically) takes the decision making process out of the hands of the courier. If the declaration says "9702000090 VATR hand-pulled limited edition screenprint @5% VAT" with all the info repeated in the correct boxes then it should be charged correctly (UK example there but the principle is the same for other countries). It doesn't always work but there is more chance of the correct rate being applied..
One of the problems is if galleries are shipping lots of pieces (e.g. after a drop) and they want to make the process of printing shipping labels easy, so they default to as little detail as possible - which works out worse for the buyer.

It's not that the edition size being bigger than 8 for statues means that it's not art, it means that it is considered as being mass-produced/commercial. For prints it isn't about the edition size but more about the method of production - so hand-pulled limited edition screenprints fall under the reduced VAT but limited edition giclees or mechanically produced screenprints don't.
France uses the Harmonized System to determine whether something is eligible for reduced rate VAT (same as the rest of the EU, the UK and pretty much most places). Customs Tariff Number Chapter 97 . Heading 9703 (for statues) "does not apply to mass-produced reproductions or works of conventional craftsmanship of a commercial character, even if these articles are designed or created by artists." Looking at the examples you have given, they wouldn't be eligible for reduced rate VAT - and I can't find any commodity code that would fit and give the reduced rate.
Someone else may have found a workaround to the commodity codes though and, on a positive note, the HS tariff descriptions (and which ones lead to reduced rates of VAT) apply across most countries so you won't be relying on French speakers / VAT experts for help with this.
Without the right codes, you won't even be able to start putting forward an argument for a refund (that applies everywhere). If you manage to find something to demonstrate that the wrong codes were used and these are eligible for reduced VAT (and I think that is a very big "if") then I am sure that someone with better French than mine will be able to help you with the forms. More ebay sellers using Global Shipping Program Why?, by hippychick on Jan 20, 2020 3:06:13 GMT 1, UK seller here - GSP can take longer and I've had one print out of about 15 lost in transit but the postage costs for fully insured international shipping beat anything I can find through UK shipping/couriers. I know that it's a complete pain if things are coming into the UK if GSP doesn't factor in the 9702 commodity code for reduced rate VAT (where applicable) but, as a UK based seller, I haven't seen the downside for me (yet!).
Oh, and for the print that was lost in transit - full refund from GSP for my buyer with no questions asked and no claim/refund from me.

The thing that might make sellers hesitant about using BBay might be if they are able to secure higher prices elsewhere, so in the end BBay would kill itself by trying to impose any kind of price caps or controls. Sellers have to be able get similar prices there as elsewhere, at similar rates of commission, fees etc, or they won't use it....... What would make sense to me would be BBay taking a % of each sale (like the eBay seller fee) to be used for charitable purposes and only agree to transfer COAs for sales that are made through BBay.
That wouldn't create financial caps and it wouldn't be any more expensive than using auction houses or galleries. The only sales model that would suffer is the direct person to person sale - so it would be a good idea to create a private sale facility within BBay, so that people don't get sniped when listing something that they want to sell to a specific person.

In 1979, when I was 10 years old, I was living in Germany as Dad was in the army. He had a conference in Berlin so he decided to take Mum, me and my next sister - so we had a week in Berlin. The wives and families had a schedule of trips and visits and one of these was a trip through Checkpoint Charlie to see the Soviet War Memorial in East Berlin.
We were staying in a hotel just off the Kurfรผrstendamm in West Berlin. That part of Berlin was so busy and lively and full of colour, noise and smells. I remember lots of women in fur coats and thinking that everything was really decadent. Oh, and German fashion sense is somewhat different (even now) so purple, mustard and green colour combinations for men was quite the norm ๐
We went through the checkpoint in an army bus and even now, 40 years on, I can clearly remember how it felt as if the colour was draining out of the world as we crossed over into East Berlin. By comparison to the West, everything was drab and grey. There werenโt many people on the street apart from the occasional queue outside a shop. Our tour guide said that was probably because the shop had got something rare in, like oranges (!).
When we got to the War Memorial everything was so quiet. Ok, so it was a cemetery so this was to be expected but after the noise of West Berlin this really stood out. Soldiers were marching around, I think that they might have been Russian, and there was an underlying feeling of threat or menace.
Iโm not normally a fan of Thierry Noirโs work but this piece, in this context, is perfect โ in my opinion. Good luck to anyone who goes to get a signed poster and please let Thierry and Stik know that they have done a fantastic job with this piece.

Coming to Trinity Leeds, as part of the new creative space BLKBOX, the Moniker Culture Leeds exhibition will be a juxtaposition of original artworks and limited edition prints from highly collected artists.
Presented in partnership with Graffiti Prints, the show will include a selection of their most iconic works from hand finished Giclee to 70 layer silkscreens; fan favorites and a rare appearance of a selection of never-seen-before variations from the Graffiti Prints Archive.

Nothing apart from the email on 7th Jan informing me that I had won, asking for my address (which I confirmed) and asking for a โshout on Urban Art Association". I was waiting to have the prize in hand for that. To be fair, I haven't chased anything up so....
