BREXIT and Double VAT, by samo on Jan 8, 2021 20:17:42 GMT 1, It’s for both : Imagine , you are selling a Banksy to a UK folk , he will have to pay 20% of the final price ( hard to write gift on a tube for a Banksy : customs have scanner as when you take the Eurostar : they stopped me because a little statue in my bag when I went to Dismaland, they already recognize “ art “ and I have had to say that it was my own artwork ( it was before Brexit ). By plane or boat, there will have customs too if you want to bring it to the Uk buyer, or when he will come back in UK. 20 % of a Banksy ?!! Enormous ( that’s why I’m a big hesitating for my poster. Maybe easier to write gift as it’s not a big one ) Now Europe is tucked too as UK is like USA. Sometimes you have no chance ( anyway DHL , etc .. does not give you any chance as you will have to pay VAT ) , as myself, by a shipping made by USPS for an Obey print : no chance, customs felt on the tube ( well only 2 times for 10 shipping ) : they asked me 34 euros fur a or Ig that I have paid 44 $ or 60 .. can’t remember. Vat should not exist ! It’s injustice ! And European will be all tucked too when Banksy will sell soon the GDP items ! Soon to come, another one or this BBay thing, I do not ask. The 'new' Brexit deal was sold to us in Dec 2020 as a 'Tariff Free' deal by Bojo ..?! Now as you can probably tell I am no expert but has anyone got a link to exactly what this 'New' arrangement is for trading art between the UK and the EU? If you buy jeans in UK you pay VAT. And if you sell it to someone outside UK the buyer will have to pay VAT. And surely admin costs. You also pay VAT over the shipping costs.
But that's the nature of VAT.... if you resell a product you (presumably) add value.

If, for example, I bought a new pair of jeans for £50 (including VAT) and then sold them to a friend in France for £50, they would have to pay VAT on the jeans after I had paid VAT on the jeans already. Plus you add custom fees on top of it too. Your friend in France will be refusing the gift at their front door and buying the jeans for cheaper in their own country instead.

I’ve just said to the seller so disappointed I can’t make a bid as the imports are just going to be too high. He has said he has looked into it for a while and he would mark it at a very low value like 20 euros which would solve the problem but then it would be insured for the real value of say £4000. Does this work because surely if he is stating the insurance value at 4K how can he mark down the value at 20 euros?? You might be on dodgy ground if the declared value doesn’t match. I recently got a letter from Parcel Force / Customs saying things didn’t match and I had to declare the true value (someone marking down something sent to me from US) Assuming the amounts haven’t changed this year, then Duty should just be 5% on art (£250 on your £4000)

I have done that for a seller in Australia ( if my memory is good ) and quite big deal. Customs have no views in insurance.

I recently got a letter from Parcel Force / Customs saying things didn’t match and I had to declare the true value (someone marking down something sent to me from US) Assuming the amounts haven’t changed this year, then Duty should just be 5% on art (£250 on your £4000)
It depends if the service I guess ? Some as La poste , national ones , are regardless .. UPS DHL etc are maybe more right. I will put “gift” anyway for simple letters no ? As for France to USA and some of the USA has done for me ( gift or low value )
Ok so here is a conundrum, I am looking at buying a secondary market via ebay for piece from France for a value of maybe £4000. I’ve just said to the seller so disappointed I can’t make a bid as the imports are just going to be too high. He has said he has looked into it for a while and he would mark it at a very low value like 20 euros which would solve the problem but then it would be insured for the real value of say £4000. Does this work because surely if he is stating the insurance value at 4K how can he mark down the value at 20 euros?? I don’t think they have import duty on things to US, or at least they seem to hardly ever get charged! Maybe China is the same. But definitely in Europe it doesn’t matter if you say it’s a gift, import duty still applies.

Customs have no views in insurance. Hmm... I remember sending artwork by tracked, insured post internationally by La Poste (the French postie) to Malta. When it finally arrived it looked like it had been eaten with a bag of nails by a serious masticator. Where it went from and to was recorded. Where the damage happened wasn't. Malta said 'Not us guv'nor.' France said 'Not us matey...' So I had to make the work again for the buyer. Not their fault obviously. So i wouldn't do anything that potentially added to the chance of the postal service insurance service saying 'Non.' Also, from France now, posters have to fill out a white customs declaration form, as well as filling out the 'non EU recipient' parts of the post office paperwork. And it's not an EU destination either - so that's an additional charge. If you want a 4K piece of work to get to you I'd ask for it to be sent by an alternative to the postal service. Especially if you want it insured and that insurance to be worth something. And yes - you will get hit by the 20% import duty. This is why I won't be shipping work to the UK unless it's all tied down in contractual paperwork between myself and the buyer regarding responsibilities for insurance, possible delays and storage in god knows what atmospheres and humidities... and any other charges... It's one big bag of shite.
I certainly won't be doing the online sales of cheap work to the UK for the forseable because as it stands at the moment HMRC expect me to register with them as an overseas business collecting VAT on their behalf. They can fuck the fuckity fuck fuck right off.

Where can we find this white custom declaration form ? In the post office ? It’s the usual CN23 no ? ( in 3 sheets ) Or it’s in + of the « non eu recipient form » ? Anyway it’s the same as USA no ? Also what about trading or exchange ( I received a too small tee, I have to paid for an exchange with a UK guy per example ? ) Just received the Phlegm book : it was sent from USA to Germany then to me, with only a custom declaration : « movie poster 25 $ «
